Judgment 1. Having heard the submissions, we notice that the conduct of the petitioner in jail is satisfactory. The Parole Committee on the basis of the adverse police report, declined to release the petitioner under Rule 9 of the Rajasthan Prisoners Release on Parole Rules, 1958 (for short Parole Rules). It is well settled that release of a convict cannot be refused merely on ipse dixit of police report. In our opinion, as per Rule 9 of Parole Rules, the petitioner is entitled to be released on parole. 2. For these reasons, the writ petition stands allowed and it is directed that petitioner Mahaveer Singh S/o Shri Ghasi Singh may be released on parole as per requirement of Rule 9 of Parole Rules subject to just and proper conditions which may be determined by the Superintendent, Central Jail, Kota. A copy of this order be sent forthwith to the Superintendent, Central Jail, Kota for compliance.
