Judgment P.S. Asopa., J.-By this writ petition, the petitioner seeks to challenge the condition imposed by the MCI to undergo full 18 months studies in MBBS in transferring medical college i.e., SMS Medical College, Jaipur. The said second phase tenure was completed by the petitioner at Kota from where he has been transferred. 2. After filing the writ petition, an interim order was passed in favour of the petitioner which was not vacated on filing an application by the respondents under Article 226 (3). During pendency of the writ petition, the petitioner has passed third phase of MBBS in the month of August, 2004. Thus, he completed his MBBS course. 3. Now all the issues raised in the writ petition as well as reply are of academic interest. In my view, any order on merit, after passing the MBBS course will serve no purpose. Since the result declared by the University is provisional, it is expected from the University, in the facts and circumstances of the case to make the same final. The writ petition is disposed of accordingly.
