U;k;ky; }kjk e`rd ds okfjlku dks fjdkMZ ij ysus ij leLr Enure Stage ij okfjlku fjdkMZ ij ekus tkrs gSA bl lEcU/k esa 1995 vkj-vkj-Mh- 547 ij dgk x;k gS fd& "(b) Order 22 — Death during pendency of the suit — Death occurred during pendency of revision before Board and L.Rs. were brought on record — Substitution made in appeal or revision, then it will be deemed to have been made in the suit." 1988 vkj-vkj-Mh- 368 ij ;g O;oLFkk nh xbZ gS fd & "Civil Procedure Code, Order 22 Rule 3 — If the legal representatives are brought on record at one stage of the suit, it will ensure for the benefit at all the subsequent stages of the suit as an appeal or a revision is a continuation of the suit itself and if such a substitution is made in the appeal or revision, it will be deemed to have been made in the suit itself but in the reverse or converse situation, this legal position would not be correct, i.e. if any substitution is made in suit when an appeal or revision is already pending in which no steps for substitution were taken that could not be projected backwards into the appeal which has already been filed before from an earlier order in the suit — Thus, once the plaintiff or deft is introduced, or, in other words once a party is brought on record at any stage, even in appeal from an interlocutory order, the party is introduced on the record for all stages — Thus, where the heirs of the deceased resps, were brought on record of the case in the second appeal they must be treated to be parties for all the stages of the suit — Hence, when there is a substitution in pending appeal or revision and the matter is remanded to the Court below, the latter had to see that the names of those who are dead, should be removed from the record and those who are substituted in the appellate Court should be brought on record and no separate application is necessary — AIR 1965 SC 1974 and AIR 1974 Patna 264 referred to." 1992 vkj-vkj-Mh- 96 ij ;g fl)kUr Áfrikfnr fd;k x;k gS fd & "(a) Civil Procedure Code, Order 22, Rule 3 — Suit for partition — Death of one of the ptffs. during pendency appeal — Some legal representatives of deceased brought on record by appellate Court — On return of file to the trial Court, remaining three daughters of deceased appeared before trial Court and presented an application relinquishing their claim in suit land — Trial Court held that the daughters of the deceased were also necessary parties but since they had relinqueshed their claim, it was not necessary to implead them — If the legal representatives are brought on record at one stage of suit, it will enure for all subsequent stages of suit, because, an appeal or revision is in continuation of the suit itself and that if such a substitution is made in appeal or revision, then it will be deemed to have been made in the suit.
