JUDGMENT 1. - This application for suspension of sentence under Section 389 Cr. PC. has been filed on behalf of applicant-appellant Rajesh Kumar Kumawat who has been convicted by the learned Additional District and Sessions Judge (Fast Track) No.1, Jaipur city, Jaipur in Sessions Case No.7/2005 for offences under Sections 493 IPC. The maximum sentence awarded is ten years R.I. and fine with default stipulation. 2. His learned counsel has contended which could not be controverted by the learned PP that the prosecutrix has herself married the applicant-appellant. After taking me through the evidence on record and the impugned judgment, he has submitted that necessary ingredients of the offence which has been found proved against him are not even made out and disclosed from the evidence on record. 3. It may not be just, reasonable and appropriate to make any observation touching the merits of the appeal at this stage. But, having regard to the submissions made at the bar, the legal and factual points raised, the materials on record, the fact that he was on bail during trial and there is no immediate prospect of his appeal being heard in near future, I deem it just and proper to suspend his sentence during the pendency of his appeal. 4. In the result, this application for suspension of sentence u/s 389 Cr. PC. is allowed and it is directed that the sentence awarded to applicant-appellant Rajesh Kumar Kumawat S/o Nathu Lal Kumawat shall remain suspended during the pendency of his criminal appeal provided he furnishes a personal bond in the sum of Rs.20,000/- together with one surety in the like amount-to the satisfaction of the trial Court for his appearance before this Court on 3/1/2006 and on all dates of hearing unless otherwise directed. *******
