ORDER 1. The Union of India is directed to produce before this Court in a sealed cover the proposal of the Central Bureau of Investigation dated 20-7-2004 and the entire file including notations pertaining to the appointment of Mr Uma Shankar Sharma as prosecutor. 2. The President, Income Tax Appellate Tribunal (for short "ITAT") is directed to send to this Court all papers pertaining to constitution of the Bench of Mr P. Mohanrajan and Mr M.K. Sarkar and also to send copies of roznamas/order-sheets of Income Tax Appeals Nos. 233-37 of 2000, 238-43 g of 2000, 251 of 2000, 227-32 of 2000 and also 373-77 of 2000. The President, ITAT also to state where Mr P. Mohanrajan and Mr M.K. Sarkar were posted prior to their being appointed to this place. The President, ITAT to also state whether Mr R.K. Tyagi was sent on deputation for two weeks during the period these two persons were appointed and, if so, why and on whose behalf he was sent on deputation. The President, ITAT also to clarify whether the Bench of Mr P. Mohanrajan and Mr M.K. Sarkar heard any other case except the cases pertaining to Mr Lalu Prasad Yadav and Mrs Rabri Devi. All documents and information to be submitted to this Court in a sealed cover within three weeks. 3. List on 15-3-2005. 4. Part-heard. Court Masters
