ORDER 1. We have heard counsel for the parties. 2. Special leave granted. 3. Counsel for the appellant pointed out to us that the judgment of this Court in Vineet Kumar v. Mangal Sain Wadhera1 has since been overruled by a larger Bench in the case of Suresh Chand v. Gulam Chisti2. There are two f subsequent decisions of this Court which take the same view. 4. In this view of the matter, counsel for the respondents is unable to support the judgment of the High Court on this aspect of the matter. However, the states that there are other questions which have to be considered by the High Court. In the facts and circumstances of the case, we remit the matter to the High Court for disposal in accordance with law. If the High Court finds that there are other questions which arise for consideration in the civil revision before the High Court, it will hear the parties and pass appropriate orders. If the High Court finds that the matter requires to be remitted to the trial court for any reason, it may do so. We express no opinion in the matter. 5. The appeal is accordingly allowed.
