Keshar Devi v. State Of Bihar

SHIVA KIRTI SINGH

body2005
Judgment 1. Heard learned counsel for the petitioner and learned counsel for the State. 2. Petitioner is complainant of Complaint Case No. 1302 of 2002 which was sent to police for lodging of F.I.R. and investigation resulting in Hajipur (Sadar) P.S. Case No. 348/2000. From Annexure-6 series, particularly petitioners petition dated 1.11.2004 filed before Chief Judicial Magistrate, Hajipur, Vaishali in connection with Sadar P.S. Case No. 348/2002 it appears that petitioner has grievance against the C.J.M., Hajipur, Vaishali. In that petition it has been mentioned that the matter was heard on the point of cognizance at length and the case was posted for orders on 30.6.2004. Allegedly the order-sheets wrongly mentioned that the matter was adjourned on the request of lawyer of the petitioner. 3. Be that as it may, unusual delay should be avoided by judicial courts. It is expected that the Chief Judicial Magistrate, Hajipur, Vaishali shall pass prompt orders in respect of cognizance, in accordance with law within eight weeks from the date of production/communication of a copy of this order. 4. The writ petition is disposed of.
