JUDGMENT 1. - Husband of the petitioner was recruited in the Grenadiers on 18.6.1945. After participating in Second World War the husband of the petitioner was discharged from service on 1.9.1945. He also died on 22.2.1973. In view of short tenure of service, husband of the petitioner was not pail any pension from the Army. Subsequently, the State Government, vide order dated 5.8.1996. granted special pension for Ex-Army Men and widow of such personnels who had participated in Second World War. The Rules were also framed in this regard under the title of 'Rajasthan Second World War Pension Rules of 1996'. Though the petitioner was initially granted pension under the above Rules on 5.9.1997, however, the same was stopped without any rhyme or reason w.e.f 6.9.1999. 2. In reply to the writ petition on behalf of the Union of India. it has been admitted that husband of the petitioner had been recruited in the Grenadiers as referred above and also received War Medal. The same is also evident from the certificate issued by the Record Officer of the Records Grenadiers, Jabalpur. However, a very strange reply has been filed on behalf of the State Government and the District Soldiers Welfare Officer, Sikar that husband of the petitioner neither participated in the Second World War nor is an Ex-Army Man. As such, the petitioner was not entitled for pension under the Rules of 1996. It has not been explained as to why and in what circumstances the petitioner was initially granted pension and the same was withdrawn subsequently. The Rules of 1996 have been framed specially for the persons who had participated in the Second World War. The certificate issued by the Record Officer clearly mentions that the husband of the petitioner had received War Medal for his participation in the Second World War. There was no justification for the respondents No. 5 and 6 i.e. the State Government and the District Soldiers Welfare Officer, Sikar to submit a contrary reply. It may be pertinent to mention that it is the duty of the District Soldiers Welfare Officer to look after the difficulties and problems of Ex-Army Men and give them all assistance for getting their dues clarified either from the Union of India or from the State Government. However, in the present case, the concerned authorities appears to have taken very insensitive approach. 3. Accordingly, the writ petition is allowed.

The respondents are now directed to continue the pension of the petitioner under the Rules of 1996 from the date it was discontinued as provided under the Rules of 1996. The arrears be paid within thirty days from the date of receipt of certified copy of this order. The respondents No. 5 and 6 shall also pay a cost of Rs. 5,000/- to the petitioner along with arrears, as referred above.Writ Petition allowed. *******
