ORDER The learned counsel for the respondent raises three preliminary objections to the maintainability of this reference. Briefly stated .they are, (i) no hearing or opportunity of showing cause againstwas given to the respondent before the President made the reference, (ii) the reference is vague, and (iii) assuming the facts stated in the reference to be correct, yet a case for proceeding ahead within the meaning of sub-article (1) of Article 317 of the Constitution does not arise. List for hearing on the abovesaid objections in the month of February 2005 on a non-miscellaneous day.
