Judgment 1. Heard both sides. 2. I.A. No. 1430 of 2005 has been filed to modify the order dated 24.7.2002 by which a direction was issued by this court that the Electricity Board should grant electric connection to a consumer after the relevant certificate of occupancy granted by the Bihar Regional Development Authority is filed before it. 3. Learned counsel for the Electricity Board Mr. Mihir Kumar Jha drew our attention to Section 43 of the new Electricity Act and Section 53 of the Bihar Regional Development Authority Act and submitted that now under the new Act a provision has been made to give connection within 30 days from the date of application and in case the same is held to be dependant upon fulfilling certain conditions as ordered by this court then the said provision will become redundant. 4. Learned counsel for the BRDA on the other hand submitted that the occupancy certificate is required before grant of electricity connection because that is included within the other services as provided under section 53 of the Act. 5. After having gone through the entire aspect of the matter, we find that Section 53 relates to the service to be provided by the Municipal Bodies and this apart in view of Section 43 of the new Act, we cannot put any restriction upon the Electricity Board. The order dated 24.7.2002 is modified to that extent. However, it is for the Board, a public body, to be satisfied before grant of electric connection that the building in which the connection is being sought has been constructed after approval of the map by the BRDA for the simple reason that unplanned growth of the town cannot be allowed. 6. Thus, the order dated 24.7.2002 is modified to the extent aforesaid and, accordingly, I.A. No. 1430 of 2005 stands disposed of. 7. Let a copy of this order be handed over to the Counsel for the Electricity Board and Mr. M.P. Gupta.
