ORDER 1. This petition under Section 406 of the Code of Criminal Procedure has been filed by the accused Amrit Singh through the jail authority, seeking transfer of the case arising out of FIR No. 568 of 2003 under Sections 412/34 IPC from the Court of Metropolitan Magistrate, Karkardooma, Delhi to the Court of the Special Judge, Mainpuri (Uttar Pradesh) where a case arising out of FIR No. 276 of 2003 under Sections 394/302/412/201 IPC is pending. 2. Heard the learned Additional Solicitor General, appearing for the respondent State of Delhi, who has no objection to the transfer of the case sought for. 3. Accordingly, case bearing FIR No. 568 of 2003 pending before the Metropolitan Magistrate, Karkardooma Courts, Delhi is ordered to be transferred to the District and Sessions Judge, District Mainpuri, U.P. who, on receipt of the case fife, may either try the same himself or assign it to some other court of competent jurisdiction. The case record of the trial court at Delhi be transmitted forthwith. 4. The transfer petition is allowed accordingly.
