Heard Mr. H.S. Paonam,learned counsel appearing on behalf of the applicant and Mr. Th. Ibohal,learned AddI. P.P. appearing on behalf of the State respondents. 2. This is an application filed by one N. Ibohanbi Singh, who is said to have been in judicial custody in connection with FIR Case No. 71(4) 05 Lamphel P.S. since 19.7.2005, praying for bail in respect of the said case. 3. I have perused the Case Diary and the bail objection report. The petitioner was arrested by police on 14.7.2005 and he was produced before the Special Judge, Manipur East on 15.7.2005. The petitioner was remanded to police custody till 18.7.05 and he has been in judicial custody since 19.7.2005. It is also ascertained that the petitioner is now undergoing medical treatment at RIMS on the recommendation of Medical Officer of the Jail and as requested by the Addl. Superintendent of Police, Central Jail, Sajiwa. I have also perused the documents filed by the petitioner showing the nature of the ailment from which he is now suffering. 4. Having regards to all the relevant considerations including the fact of hospitalization of the petitioner, I consider that it will be proper and just to release the accused on bail. It is, therefore; ordered that the petitioner, namely, N. Ibohanbi Singh, be released on bail on his executing a P. R. bond of Rs. 4O,OOOj- with the surety of the like amount to the satisfaction of the Iearned Special Judge, Manipur East, Imphal. The petitioner is to undertake that he will not do anything prejudicial to the prosecution. A copy of this order be sent to the learned Special Judge, Manipur East, Imphal for information.
