Judgment N.K.Sud, J. 1. This appeal is directed against the award of the Motor Accident Claims Tribunal, Ambala (for short "the Tribunal"), dated 3.6.1986 whereby the Tribunal has held that the appellant has failed to prove that he was injured in a road accident on account of rash and negligent driving by the driver of the truck belonging to Unit No. 24, Medium Regiment, based at Ambala. 2. The appellant had claimed that on 13.7.1984, he had gone to Ambala Cantt., Courts to drop one Deepak Sharma on his scooter. While he was returning, a military truck which was being driven in a rash and negligent manner struck him from behind as a result of which he fell down and became unconscious. It was further claimed that military truck stopped after the occurrence and Deepak Sharma, who was an eye witness, noted the truck number. The accident is also stated to have been witnessed by S.C. Jaswal, Advocate. 3. On a consideration of oral and documentary evidence led by the parties, the Tribunal observed that the respondents, on the basis of documentary evidence i.e. the record of the military authorities, had proved that the vehicle in question was on duty at Jalandhar in Blue Star Operation and the driver Harbhajan Singh was also there from 5.7.1984 to 27.7.1984, whereas the accident had taken place on 13.7.1984. The Tribunal also observed that the truck number given by the eye witnesses was different from the vehicle in question. It has also been observed that the version of the Army authorities, based on entries in the official record, could not be discredited even in the cross examination. 4. In this view of the matter, I am of the view that the Tribunal was perfectly justified in holding that the vehicle in question was not involved in the accident as claimed by the appellant. 5. No other point has been raised. 6. In this view of the matter, I find no merit in this appeal which is, accordingly, dismissed. No costs.
