ORDER S.J. Mukhopadhaya, J. 1. The petitioner has challenged the Notification Nos. Ru- De-4(Sta)-389/2,001-3377 and Ru-De-4(Sta)-389/2001-3351, dated 29th June, 2005, whereby and whereunder, he has been transferred from the post of Assistant Engineer, Rural Development (Special Division), Hazaribagh to the post of Assistant Engineer, Rural Development (Special Division), Palamau. 2. The main grievance of the petitioner was that the notifications of transfer were issued not on the recommendation of any Establishment Committee but for some other consideration. 3. The case was earlier taken up and notice was issued on 6th respondent, Md. Alimuddin, who was posted in place of petitioner 6th respondent has already appeared. 4. Counsel for the State submitted that the matter having been reconsidered, fresh notification has been issued on 29th August, 2005 cancelling the transfer orders of both the petitioner and 6th respondent; this writ petition has become infructuous. It is submitted that though the order has been cancelled but the competent authority has jurisdiction to transfer the petitioner, in accordance with law. 5. Counsel for 6th respondent submitted that 6th respondent was waiting for posting and has not been paid salary since 11th. November, 2004. The counsel for 6th respondent requested to direct the respondent to post the 6th respondent against a vacant post, order of posting having been cancelled. 6. In the facts and circumstances, while no further order is required to be passed in respect to the petitioner, the respondents are directed to post the 6th respondent against a clear vacant post within 15 days from the date of receipt/ production of a copy of this order. 7. On his joining, 6th respondent be also allowed the admitted salary to which he is entitled, including the salary for the period he was waiting for posting. This writ petition stands disposed of, with the aforesaid observations.
