H.K.SEMA, S.N.VARIAVA

body2005
ORDER : S.N. Variava, J. Delay condoned. 2. Leave granted. 3. Heard parties. 4. By the impugned Order, which is dated 5th July, 2004, the National Consumer Disputes Redressal Commission has dismissed the Revision Petition against an Order of the State Forum which increased interest of 18% p.a. This Court has already in the case of Ghaziabad Development Authority v. Balbir Singh reported in (2004) 5 SCC 65 held that award of interest at the blanket rate is not justified. We, therefore, set aside the impugned Order, remit the matter back to the National Commission to deal with it in accordance with the principles laid down by us in the afore-mentioned decision. The Appeal stands disposed of accordingly. 5. The Commission is requested to dispose of the Revision Petition as expeditiously as possible.
