JUDGMENT 1. - Heard learned counsel for the petitioner(s) as well as the learned public Prosecutor and perused the material/case diary made available to me during the arguments of the case.Learned counsel for the petitioners submits that although there is an allegation about the offence against the petitioner but in the statement of the prosecutrix recorded u/s. 164 Cr.PC. by the Judicial Magistrate, Neem-Ka-Thana dated 10th Dec., 2004, it appears that prosecutrix herself went with the petitioner and this appears to be a case of consent. The prosecutrix is major as aged about 19 & 1/2 years. The petitioner is in judicial custody for about last two months. 2. Taking into consideration all the facts and circumstances of the case I consider it just and proper to release the accused-petitioner to namely Mahendra Singh S/o Shri Richhpal Singh on bail under Section 439 Cr.P.C. in FIR No. 410/04 Police Station Neem-Ka-Thana, Sikar provided he furnishes a personal bond in the sum of Rs. 25,000/- together with one surety of the like amount to the satisfaction of the learned trial Court for his appearance before that court on all subsequent dates of hearing and as and when called upon to appear.Bail granted. *******
