( 2 ) CASE-DIARY of Crime No. 140 of 2004 registered at Police Station: Magarioad district Dhamtari for the offences punishable under Sections 363, 366-A and 376 of the Indian Penal Code perused. ( 3 ) THE case of the prosecution is that a report of abduction was lodged on 29/6/2004 by the father of the prosecutrix namely Bhuvreshwari Bai stating that the girl was missing from 26/6/2004. The girl was recovered on 26/9/2004. The statement of the girl was recorded in which she disclosed that she had gone with applicant to Assam and there they performed marriage also. ( 4 ) LEARNED Counsel appearing for the accused! applicant submits that the girl was in love with applicant and she also delivered a male child on 7/9/2004. Learned counsel appearing for the State does not dispute this factual aspect as this fact is mentioned in the statement of the girl. However, he opposes the prayer for bail on the ground that the girl was minor on the date incident. One school certificate has been produced by the prosecution and according to which the date of birth of the girl is 10/6/1989 which comes about 15 years and 3 months on the date of the incident. ( 5 ) CONSIDERING the facts and circumstances of case and also considering the fact that except the school certificate, there is no other evidence in relation to the age of the girl and the matter is one of marginal age this Court is of the opinion that it is a fit case in which the application is allowed. The accused/applicant is directed to be released on bail on his furnishing a personal bond in the sum of Rs. 10,000. 00 (Rupees Ten Thousand Only) with one surety in the like sum to the satisfaction of the trial Court concerned for his appearance before the said Court or any other Court so directed.
