ORDER : 1. I.A. No. 71A (filed on behalf of All India Judicial Employees Confederation and treated as substantive application) and I.A. No. 142/2003 (for Directions) in WP (C) 1022/1989 2. Most of the States/UTs have not filed their response to the applications in spite of enough time having been allowed for the purpose. A last opportunity of four weeks is allowed for filing the responses in terms of order dated 17-1-2005 and in the light of the recommendations made by the Shetty Commission failing which it shall be assumed that such of the States/UTs who do not file response have nothing to say in opposition to the prayer made in the application. Letters dated 20-1-2005 and 5-3-2005 received from the Rajasthan High Court. 3. The learned counsel for the State of Rajasthan has the copies of the communications dated 20-1-2005 and 5-3-2005 from the Registrar General of Rajasthan High Court, Jodhpur available with him. On being asked to respond on what has been stated in these communications, the learned counsel prays for time being allowed for having instructions. Let him have instructions and file response on affidavit within three weeks. We make it clear that in order to carry out the directions made by this Court as to the mandatory training of judicial officers before they are posted in Courts, the Judicial Academy has to be made functional by providing necessary infrastructure to the satisfaction of the High Court. In case that is not done or the process is delayed, may be the judicial officers who have been selected and appointed are required to undergo a training programme by being sent to a Judicial Academy of some other State in which case the State of Rajasthan shall have to bear the expenses of training. 4. List after four weeks for hearing in I.A. Nos. 71A and 142 in WP (C) No. 1022/1989 and on the communications received from Rajasthan High Court. Order accordingly.
