Judgment N.N. Mathur, J.-We have heard the learned Counsel for the appellant and perused the order of the learned Single Judge dismissing the writ petition. 2. The say of the appellant is that in response to the advertisement No. 10/98 for recruitment on the post of Teacher Grade III, he submitted an application to the second respondent Zila Parishad, Bikaner. He possessed the qualification of Senior Secondary passed from the Board of Secondary Education, Ajmer. As per the notification dated 26.2.2000 a person possessing the qualification of Secondary or Senior Secondary have undergone a vocational course was qualified to be appointed. Thus, the appellant was asked to produce the requisite certificates to show that he has undergone the vocational course. It is not in dispute that the appellant failed to produce the mark-sheet of the Bridge Course. In view of this he was not given appointment. 3. It is submitted by the appellant that his case is covered by the decision of Sunita Sharma & Ors. vs. State of Rajasthan & Ors., reported in JT 2001 (10) SC 178, wherein Senior Secondary (Academic) has been held to be equivalent to Senior Secondary (Vocational Examination). In view of the Sunita Sharmas case (Supra), even if the appellant failed to produce the mark-sheet of the Bridge Course, as he had passed Senior Secondary Examination, he could have been given appointment. 4. Consequently, the appeal is allowed. The order of the learned Single Judge dated 7.2000 is set aside. The respondents are directed to consider the case of the appellant in the light of the decision of the Apex Court in Sunita Sharmas case (Supra).
