JUDGMENT Perused the challan papers submitted by counsel for the applicants for perusal. This is first bail application under section 439 of CrPC by the applicants, who are in custody in connection with Crime No. 14/05 registered at Police Station Gijora, District Gwalior, for committing offence under section 392 of IPC and under section 11, 13 of MPDVPK Act. It is alleged that the applicants have looted silver ornaments (Kadiyan) of the complainant, when she was sleeping. But the submission of learned counsel for the applicants is that from the first information report and from the statement of the complainant before police recorded under section 161 of CrPC, it is clear that even the complainant was not sure that the applicants have looted her ornaments. Nothing has been seized from the applicants. It is submitted that the applicants have been falsely implicated. The applicants are in custody since 21.3.2005 and after investigation, challan has been filed. The disposal of the case is likely to take time. Considering the above facts, but without expressing any opinion on the merits of the case, application is allowed. It is directed that the applicants be released on bail on their furnishing personal bond in th~ sum of Rs. 30,000/- (Rs. thirty thousand only) each with one solvent surety each in the like amount to the satisfaction of the trial Court.
