JUDGMENT Learned counsel for the applicants prays for and is granted permission to withdraw this application so far as the applicant No. 1 Gunneram is concerned. His application is dismissed as withdrawn. So far as the applicant No.2 Kastoori Bai is concerned, heard learned counsel for the paJ1ies and perused the case diary. This is first application for anticipatory bail under section 438 of CrPC by the applicant No.2 Kastoori Bai, who is apprehending of her arrest in Crime No. 19/2005 registered at Police Station Gondan, District Datia for committing offence under sections 3071149, 147, 148, 353, 332 of IPC and under section 11 & 13 of MPDVPK Act. It is stated that the SDOP Bhander, received secret information that some Badmash are staying in the house of the applicant. It is alleged that when SDOP alongwith police party went to the house of the applicant, then co-accused Harnam and Gunneram started firing at the police party and some other co-accused also started firing. The allegation against the present applicant is that she started throwing stones and bricks over the police party, causing injuries to police constables. But, the submission of learned counsel for the applicant is that the applicant has been falsely implicated and the story of the prosecution is concocted one. It is submitted that no specific injury has been attributed to the present applicant. The applicant is stated to be an old lady of 65 years. Injuries to the injured are simple in nature. Co-accused Dashrath has already been granted bail after his arrest. Considering all these facts, but without expressing any opinion on the merits of the case, application is allowed. It is directed that in the event of arrest of applicant No.2 Kastoori Bai in the above stated case, she be released on bail on her furnishing personal bond in the sum of Rs. 30,000/ (Rs. thirty thousand only) with one solvent surety in the like amount to the satisfaction of the Investigating Officer/Arresting Authority, subject to the conditions enumerated under section 438 (2) of CrPC. This order shall remain in force for a period of thirty days and meanwhile, she may surrender and apply for regular bail. Certified copy as per rules.
