Judgment Surya Kant, J. 1. The prayer in this petition under Section 439 Cr.P.C. is to release the petitioner on regular bail in complaint case pending in the Court of Chief Judicial Magistrate, Nawanshahar under Sections 302/201/120-B/34 IPC. 2. Notice of the petition was sent, service is complete, however, no one turns up on behalf of respondent No. 2. 3. In support of the afore-mentioned prayer, Learned counsel for the petitioner points out that the alleged occurrence had taken place on 9.1.2003 and in relation thereto FIR No. 11, P.S. Rahon, District Nawanshahar was registered on 5.2.2003. The petitioner was named as one of the accused in the said FIR. According to him, on investigation, the allegations made against the petitioner and his co-accused were found to be false, rather the Investigating Agency while recommending cancellation of case, also recommended that the complainant be prosecuted under Sections 182, 195, 211 IPC. He further submits that it was after the lapse of a period of about one year that on 2.4.2004 the criminal complaint in question has been filed in which the petitioner is now in custody. He points out that the co-accused of the petitioner have already been granted interim pre-arrest bail by an order dated July 1, 2005 passed in Crl. Misc. No. 31811-M of 2005. 4. Learned Counsel for the petitioner also points out that the case is likely to take a considerably long period. These facts are not being disputed by the Learned State counsel. 5. Without going into the merits of the case but having regard to the fact that the petitioner has already been found innocent by the Investigating Agency and the conclusion of the trial is likely to take a long time, he is directed to be released on bail to the satisfaction of Chief Judicial Magistrate, Nawanshahar.
