ORDER 1. Petitioner is one of the accused in Crime No. 92/2005 of Virajpet Town Police Station, registered for the offences punishable under Sections 128-A, 144 and 165-A of Karnataka Forest Rules r/w 71-A of Karnataka Forest Act. 2. The complaint and investigation records disclose that accused Nos.1 and 2 viz., Saji and Satish were found transporting beete logs in a lorry at 5.00 a.m. on 20-9-05. The lorry as well as beete logs were seized under the Panchnama. During the investigation, Accused No. 1- Saji stated before the police that these logs were loaded from the land of the petitioner herein. His statement further discloses that the beete logs were loaded at the request of three persons, whose names are yet to be known to the police. 3. The only allegation that is forthcoming against the petitioner is that, from his land, the logs were loaded. Looking to the nature of allegation, the petitioner may be shown leniency by granting the order of Anticipatory bail for a limited period, so as to enable him to surrender before the police. The said process may also help the police to investigate further. 4. Hence, the following order is made : Criminal Petition is allowed. The petitioner is directed to surrender before the Investigating Officer within three weeks from today. In the event of his surrender/arrest, he shall be released on bail subject to the following conditions :— i) He shall execute a bond for a sum of Rs. 50,000/- (Rupees Fifty thousand) with two sureties for the like sum to the satisfaction of the Investigating Officer. ii) He shall mark his presence on every Sunday between 10.00 a.m. and 2.00 p.m. before the Station House Officer, Virajpet Town Police Station. iii) He shall attend to the trial Court regularly and shall not tamper the prosecution witnesses. iv) He shall co-operate during the course of investigation. 5. The aforesaid order of Anticipatory bail shall remain in force for six weeks. It is open for the petitioner to file application for bail, before the Jurisdictional Court. 6. Petition allowed.
