Judgment Rajive Bhalla, J. 1. The petitioner seeks grant of regular bail in case FIR No. 7, dated 29.1.2005, registered under Section 306 IPC, at Police Station Sadar Abohar, District Ferozepur. 2. The allegations, against the petitioner, are that he facilitated the grant of three loans to the deceased. Though the loan papers were signed by the deceased, money was retained by Mohinder Kumar, the petitioner. Despite a compromise before the Panchayat to repay Rs. 50,000/-, the petitioner did not repay the amount. It is further alleged that Immi Lal, deceased, had to pay another amount to the Bank, due to which he became mentally disturbed and committed suicide. 3. Counsel for the petitioner contends that the petitioner has been falsely implicated. The investigation is complete, challan has been presented, the evidence is going on and, therefore, the petitioner should be released on bail. 4. Counsel for the respondent, on the other hand, contends that the present petition be dismissed, as the petitioner is not entitled to the concession of bail. The petitioners act led to the suicide by the deceased. 5. The question, whether the petitioner was, in any manner, responsible for the suicide of the deceased, would be determined during the course of trial. Admittedly, the investigation is complete, challan has been presented and charge framed. The evidence is in progress and, therefore, to incarcerate the petitioner any further would serve no useful purpose. 6. Without expressing any opinion on the merits of the case, bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Ferozepur.
