ORDER 1. Heard. 2. A prayer has been made in this application to dispense with the personal appearance of the Petitioner and to allow him to be represented under the provision of Section 205 of the Code of Criminal Prodecure. 3. The admitted fact is that this benefit was earlier granted to the petitioner who is the Executive President of the-Sugar Mills. However, it appears that the case was transferred from Patna to Samastipur. No notice was given to the petitioner with regard to transfer of the case and in such a circumstances the petitioner did not appear before the court concerned as a result of which warrant of arrest has been issued against him. 4. After the order of transfer to the case, as there was no notice to the petitioner, the point taken that there is bona fide mistake in not appearing in the court in absence of any notice appears to be acceptable one. Accordingly, the impugned order is set aside and the petitioner is allowed to be represented under Section 205 of the Code of Criminal Procedure as ordered by the Sub-divisional Judicial Magistrate, Patna. However, at the stage of 313 of the Code of Criminal Procedure and as and when required by the court the petitioner shall remain present in the court below. 5. This revision application is accordingly allowed.
