Prem Nath v. Gurdial Singh

2005-08-09

JASBIR SINGH

body2005
Judgment Jasbir Singh, J. 1. Vide order, under challenge, application of the respondent-landlord, under Order 6 Rule 17 CPC, to amend his application, was allowed. This Court is of the opinion that the order passed is perfectly justified. Ejectment application is pending before the Rent Controller since 1997. As per averments, made in application for amendment, during pendency of the proceedings, three daughters of respondent-landlord had acquired M.Sc. Degree and now they intended to start coaching classes in the premises in dispute. This Court is of the opinion that facts, on the basis of which, amendment has been granted, are subsequent to the filing of ejectment application. No case is made out for interference.
