JUDGMENT 1. - Heard learned counsel for the petitioner and Public Prosecutor for the State. Perused the order impugned. 2. It is contended by the learned counsel for the petitioner that co-accused- Raju alias Khadia, Ramdev, Shanker Singh alias Girwar and Badrilal have already been acquitted by the trial Court vide judgment and order dated 13.7.2004 and there is same'set of evidence against the petitioner. Be that as it may having regard to the facts and circumstances of the case and the fact that co-accused have already been acquitted on the same set of evidence, I consider it just and proper to enlarge the accused-petitioner on bail. 3. Accordingly, the bail application filed u/s. 439 Cr.P.C. is allowed and it is directed that petitioner-Kailash Chandra alias Kalu S/o Banshilal Mochi be released on bail in FIR No. 59/2002, P.S. Bhupalpura, Udaipur provided he furnishes a personal bond in a sum of Rs. 20,000/- with two sound and solvent sureties in the sum of Rs. 10,000/- each to the satisfaction of learned trial Court for his appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial.Bail application allowed. *******
