ORDER SLP (C) No. 5870 of 2005 1. Learned counsel for the petitioner seeks permission to delete the name of Respondent 2 from the array of the parties. Prayer granted at the risk of the petitioner. Learned counsel for the petitioner further submits that he is prepared to pay penalty imposed on him and subject to the result of this petition the respondent may be directed to release the goods. We find no reason as to why the goods should not be released when the duty and penalty has been paid subject to the result of the petition. 2. Leave granted in all the matters. 3.
