R.S.SODHI

body2006
R. S. SODHI, J. ( 1 ) ALLOWED subject to just exceptions. Applications disposed of. Counsel for the petitioners submits that the petitioners are not seeking amendment in respect of property bearing No. 143/2-A but they are seeking amendment in respect of property bearing No. 143/2-B and want to make a clean break of any impression that amendment is being sought in respect of property bearing No. 143/2-A. ( 2 ) HEARD counsel for the petitioners. It appears to me that the trial court has returned a finding that "in fact the plaintiffs, part from challenging the sale deed, are also trying to challenge the Sale Deed executed by defendant No. 1 in favour of Defendant No. 2 in the year 1992 with respect to the property bearing No. 143/2-A, Gadodia Market, Khan baoli, Delhi. " Since the petitioners are making it clear that they do not wish to incorporate any amendment challenging the sale of property bearing No. 143/2-A, Gadodia market, Khan Baoli, Delhi. The trial court may consider the application of the Petitioners qua property bearing No. 143/2-B, Gadodia market, Khari Baoli, Delhi, in accordance with law after hearing the other side. With this, CM (M) 3091-3092/2005 and cm APPL. 17368/2005 are disposed of. .
