Judgment 1. Counsel for the State has brought to my notice order dated 6.2.2006 recording that five witnesses were present, but counsel for the accused did not come present due to death of his brother and the witnesses had to be discharged. In view of this position, counsel for the petitioner, after some arguments, seeks permission to withdraw the petition. Accordingly, the petition is dismissed as withdrawn.
