ABHIJIT SINHA, NARAYAN ROY

body2006
Judgment 1. Heard counsel for the parties and considered the counter affidavit filed on behalf of the State. 2. Initially an impression was given to the Court that the minor daughter of the petitioner was kidnapped. Accordingly this writ application was entertained and State counsel was directed to put in affidavits. The matter, thereafter, was heard on 7.9.2006. On that day, it was brought to the notice of the Court by the State counsel that the victim girl is already major, as her marriage was settled in 2005. This fact has been stated by the father of the victim girl in the complaint petition itself. 3. The affidavits filed on behalf of the State manifestly demonstrate that the investigation of the case was completed, so far the arrested accused persons are concerned and it is still going on, so far the absconding accused persons are concerned. 4. This Court vide order dated 7.9.2006, however, directed the petitioner to supply the latest photographs of the victim girl to the Senior Superintendent of Police, Patna, so that the same may be circulated to trace out her. 5. We are informed by the State counsel that the photographs were handed over to the police, which have been published in the newspaper and also through other medias and the police is trying to get the clue and to trace out the victim girl. 6. Since the investigation of the case has been completed, so far the arrested accused persons are concerned and it is pending, so far the absconding accused persons are concerned, in our opinion, no further direction is required from this end. For the reasons aforementioned, therefore, this application is dismissed.
