Judgment 1. Heard learned counsel for the petitioners and the State. 2. Petitioners are apprehending their arrest in connection with a case registered for the offences under Ss. 323, 324, 448, 143, 379 and 504 of the Penal Code. 3. It is submitted on behalf of the petitioners of Cr. Misc. No. 42998 of 2006 that during investigation police had admitted the petitioners on police bail and thereafter the police submitted charge-sheet under the bailable sections but the learned Magistrate differing with the same took cognizance even for the offence u/s. 307 of the Penal Code. So far petitioner of Cr. Misc. No. 43300 of 2006 is concerned, against him also police submitted Final Form but the court below has taken cognizance for the offence under Section 307 of the Penal Code. In the circumstances, prayer is to admit them on bail in the event of arrest. 4. In the facts and circumstances of the case, as the petitioners have not misused their privilege of police bail, I direct that during the trial, the petitioners, namely, (1) Kripanand Prasad @ Karu Yadav, (2) Bipin Yadav, (3) Santosh Kumar @ Santosh Yadav and (4) Jai Prakash Narain @ Babloo Yadav (in Cr. Misc. No. 42998 of 2006) and Akhilesh Kumar @ Munna Yadav (in Cr. Misc. No. 43300 of 2006) should surrender in the court below within a period of four weeks from today and in the event of their so surrendering they should be continued on bail until trial on furnishing bail bonds of Rs. 5000.00 (Five thousand) each with two sureties of the like amount each to the satisfaction of Sri Ramchandra Prasad, Judicial Magistrate, 1st Class, Biharsharif at Nalanda in connection with Deepnagar Police Station Case No. 180 of 2003, subject to the conditions as laid down u/s. 438(2) of the Cr.P.C.
