ORDER : 1. Detailed directions in respect of action plan for stray animals were issued in terms of the order dated 17th March, 2005. Thereafter, further time was granted in terms of the order dated 24th August, 2005. As per the office report, fourteen State Governments/Union Territories have filed their affidavits/additional affidavits. We see no ground to grant any further time to the State Governments/Union Territories who have not filed affidavits in terms of the order dated 17th March, 2005 despite such a long lapse of time. The copies of the affidavits shall be supplied to learned counsel for the petitioner, Mr. A.D.N.Rao, learned counsel appearing for the Union of India and also to Mr. Raj Panjwani, learned counsel appearing for Animal Welfare Board of India. The petitioners, Mr. Raj Panjwani and Mr. A.D.N.Rao shall discuss the matter and prepare their suggestions having regard to the stand taken in the affidavits/additional affidavits. 2. The petitions are adjourned. I.A.No. 8 in W.P.(C) No. 440/2000: 3. The application seeks issue of directions in regard to release of 243 monkeys under the custody of NCT of Delhi. Learned counsel states that the number has now increased to 300. In the application, reference has been made to a letter written to the Chief Wildlife Warden, Madhya Pradesh for giving custody of the monkeys to the State of Madhya Pradesh and also to a meeting held in the Ministry of Environment & Forests, Government of India to sort out the problem of release of monkeys. Reference has also been made to a letter of the Principal Secretary (Forests), Government of Madhya Pradesh expressing their inability to accept more monkeys. 4. For the present, we direct that these 300 monkeys be handed over to the Chief Wildlife Warden, Madhya Pradesh. 5. The application is disposed of accordingly.
