JUDGMENT 1. - This bail application has been filed by the petitioners Balveer @ Bailo Rama and Lalo, who apprehend their arrest FIR No. 55/2006 registered at Police Station Sawalgarh (Muraina) (M.P.) for offence(s) under section 498A, 34 IPC (seeking an interim direction under section 438 Cr.P.C. to enable them to approach the court of competent jurisdiction in Madhya Pradesh for grant of regular direction under section 438 Cr.P.C. 2. Heard learned counsel for the petitioners and learned Public Prosecutor for the State. 3. Learned counsel for the petitioners, in support of his contention placed reliance on the judgments rendered in Rajendra Moondra v. State of Rajasthan & another, 2000(2) R.C.C. 1478 ; Chandan Mai Jain v. State of Maharashtra & State of Raj. 2001(1) R.C.C. 253 ; and Neela J. Shah v. State of Gujarat, 1998(2) Crimes 261 , wherein it has been held that transitory bail can be granted to an accused how reasonably apprehends his arrest and who resides within the jurisdiction of the court and the case against him is pending investigation in jurisdiction of another High Court to provide him immediate relief so as to enable him to approach the concerned court having jurisdiction for his release on anticipatory bail. 4. Learned Public Prosecutor has no serious objections to the grant of transitory bail to the petitioners. 5. Having considered the submissions made at the Bar and keeping in view the principles of law laid down in the cited authorities and looking to the nature of allegations against the petitioners, it appears to be a fit case for grant of transitory bail to the petitioners for a period of fifteen (15) days from today. 6. Accordingly, this transitory bail application is allowed and it is directed that in the event of their arrest, accused petitioners Balveer @ Ballo son of Ram Prasad, Rama wife of Ram Prasad and Lalo daughter of Damodar, shall be released by the concerned S.H.O. on bail for a period of 15 days from today provided each of them furnishes a personal bond in the sum of Rs. 20,000/- with one surety in the like amount to the satisfaction of the concerned S.H.O./Investigating Officer. The petitioners may approach the appropriate court in the State of Madhya Pradesh within 15 days from today. Life of the order is only up to 28.4.2006 and thereafter it shall stand cancelled automatically.
