Through the instant writ petition, the petitioner claims promotion to the post of Painter with effect from the date his junior Kishore son of Om Parkash was promoted as such. In fact, the claim of the petitioner is that the petitioners seniority over the aforesaid Kishore son of Om Parkash came to be finalised vide order dated 18.3.2004 (Annexure P1 ). It is, therefore, that a right accrued to him to claim promotion from the date a person junior to him was promoted against the post of Painter. 2. Learned counsel for the petitioner states that in order to claim retrospective promotion with effect from the date his junior Kishore was promoted as Painter, the petitioner issued a legal notice dated 28.4.2005 (Annexure P2 ). It is, however, pointed out that no decision has been taken thereon till date. 3. Learned for the petitioner states that the petitioner will be satisfied if the instant writ petition is disposed of by requiring respondent CWP NO 4487 OF 2006 2 no.3 i. e. the General Manager, Haryana Roadways, Jind, to take a final decision on the legal notice dated 28.4.2005 (Annexure P2 ). 4. In view of the above, without going into the merits of the claim raised by the petitioner, we consider it just and appropriate to dispose of the instant writ petition by directing respondent No.3 i. e. the General Manager, Haryana Roadways, Jind, to take a final decision on the legal notice dated 28.4.2005 (Annexure P2), by passing a well reasoned speaking order within three months from the date of receipt of a certified copy of this order. Disposed of accordingly. Order dasti on payment of usual charges.
