Order Heard. 2. The petitioner stands involved in a case registered under Section 376 of the Indian Penal Code. 3. Learned counsel for the petitioner submitted that although he is said to have forcibly continued to have sexual relationship with the informant, the first information report was lodged after six years. It is also submitted that the falsity of the allegation may be apparent vide Annexure-2, the petition filed by the petitioner to the police, on which a proceeding under Section 107 of the Code of Criminal Procedure is pending between the parties. Therefore, he may be admitted to anticipatory bail. 4. Learned A.P.P. for the State opposed the contention. 5. In the facts of this case, I am inclined to admit petitioner Ram Prasad Munda @ Ramu to anticipatory bail, in the event of his arrest/surrender, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of Chief Judicial Magistrate, Hazaribagh in connection with Patratu (Barkakana) Police Station Case No. 71 of 2006 corresponding to G.R. No. 862 of 2006, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
