Judgment ( 1 ) THE writ petition was admitted vide order dt. 2. 8. 2005, and interim order of status quo was granted as it existed on that day, and the matter comes up today for confirmation of stay. ( 2 ) LEARNED counsel for the respondent raised a preliminary objection about maintainability of the writ petition on the ground of availability of alternative remedy by way of appeal before Rajasthan Civil Services appellate Tribunal. A specific preliminary objection has been taken in this regard in the reply. ( 3 ) IN that view of the matter, learned counsel for the petitioner seeks to withdraw the writ petition with liberty to approach the Tribunal within a period of two weeks from today. ( 4 ) THE writ petition is accordingly dismissed as withdrawn with aforesaid liberty. It is, however, clarified that since there is interim stay order of this Court passed on 2. 8. 2005, that interim order shall continue for a period of four weeks, or till the matter for grant of interim relief is considered by the Tribunal whichever is earlier.
