ORDER : 1. Mr. B.S. Malik, learned senior counsel appearing for the petitioner desires to withdraw this petition. Petitioner is allowed to withdraw the petition. The criminal miscellaneous petition is dismissed on withdrawal. 2. These petitions are delinked from the rest of the petitions. Criminal Appeal No.406 of 2004 to be listed along with these petitions after eight weeks. Union of India and all the State Governments have been arrayed as the party respondents. Despite grant of sufficient time, except State of Sikkim, none has filed counter-affidavit in the amended writ petition. We grant further eight weeks' time to all the State Governments to file counter- affidavit in the amended writ petition. Such counter- affidavits must be filed by a person who is having an authority in the running State Government preferably by a Secretary (Home Department). The respective States must file counter-affidavit pre-emptorily within eight weeks. 3. The State of U.P. is allowed to file a detailed affidavit within eight weeks. List thereafter. Petitioner may also file additional documents in the meantime.
