( 1 ) EXEMPTION is allowed subject to all just exceptions. Bail Appln. No. 2644-45/2006: ( 2 ) THE petitioners seek anticipatory bail in case vide FIR No. 40/2006 under section 420, IPC registered against them with Police Station Connaught Place. ( 3 ) NOTICE. Mr. Sunil K. Kapoor and Mr. Sunil Sharma APPs for the State accepts notice for the State. Mr. Vijay Aggarwal, Advocate is also present for the complainant. ( 4 ) AT the outset, the learned APP for the State has opposed this bail application on the ground that both the petitioners had earlier applied for their anticipatory bail and the Court had heard arguments for about half-an-hour and when the Court was going to reject their anticipatory bail, the learned Senior Counsel appearing for the petitioners on that day sought permission to withdraw the bail application and the earlier application was therefore dismissed as withdrawn. The earlier bail order is at of the paper book. ( 5 ) UNDER the circumstances, I am of the view that the second anticipatory bail application does not lie. This bail application is, therefore, rejected and stands disposed of. Bail application rejected.
