body2006
Judgment Jasbir Singh, J. 1. This petition has been filed under Sec.438 Cr. P. C. with a prayer for grant of anticipatory bail in FIR No.28, dated February 15, 2006, for commission of offences under Sections 323, 324, 427, 452/34 IPC, registered at Police Station City Kapurthala. Accusation against the petitioner is not very serious. During arguments, by referring to document Annexure P-1, it has been brought to the notice of the Court that the parties have amicably settled their dispute. This fact has not been controverted by the State counsel, on getting instructions of Dalbir Singh, ASI. State counsel informs this Court that the complainant has filed an affidavit to that extent, which is available on the police file. In view of facts, mentioned above, this petition is allowed and it is ordered that in case of arrest of the petitioner by the investigating Officer, he be released on bail subject to his furnishing bail bonds to the satisfaction of that officer. The petitioner is further directed to comply with the terms and conditions, as contained in Sec.438 (2) Cr. P. C.
