( 1 ) BY this application under Section 438 read with sections 482 Cr. P. C, petitioners are seeking anticipatory bail in case FIR No. 821/2005 under Sections 308/34 IPC, p. S. Saraswati Vihar, Delhi. ( 2 ) PROSECUTION allegations are that the complainant (Prem Singh) along with his two relations (Devender and cousin brother Manish) were working in the factory (M/s. H. S. Fashion) owned by co-accused (Harpal Singh ). They left his employment and started working in some other factory (M/s. Chaudhary fashions ). Feeling aggrieved about the same on 28. 08. 2005, Petitioners along with co- accused stated to have met the complainant and his relations, while they were coming back home at night and assaulted them with danda etc. as a result of which Prem Singh, devinder and Manish received injuries. Learned counsel for the petitioners submits that petitioners themselves were assaulted and were treated by the doctor at Dr. Sukhwani s clinic on the night intervening 28/29. 08. 2005 and in support of their submission, reliance is placed on Annexure - B, Learned APP for the state, on instructions from SI Anil Kumar, submits that the certificate has been verified from the doctor and no such record is available with the doctor and opposes the prayer for bail. Petitioners have already joined the investigations on number of dates. ( 3 ) IN the facts and circumstances of this case, application is allowed and petitioners are ordered to be released on bail on each of them furnishing personal bond in the sum of rs. 10,000/- with one surety each on the like amount to the satisfaction of the SHO/ arresting Officer. Application stands disposed of. .
