( 1 ) BAIL Application No. 2403/2005 by this application under Section 438 read with section 482 Cr. P. C. petitioner is seeking anticipatory bail in case FIR No. 821/ 2005 under Sections 308/34 IPC, p. S. Saraswati Vihar, Delhi. ( 2 ) PROSECUTION Allegations are that the complainant (Prem Singh) along with his two relations (Devender and cousin brother Manish) were working in petitioner s factory (M/s. H. / s. Fashion ). They left petitioner s employment and started working in some other factory (M/s. Chaudhary Fashions ). Petitioner was feeling unhappy about the same and on 28. 8. 2005, petitioner along with others stated to have met the complainant and his relations, while they were coming back home at night and assaulted them with dandas etc. as a result of which Prem Singh, Devenderand manish received injuries. Learned counsel for the petitioner submits that petitioner himself was assaulted and was treated by the doctor at Dr. Sukhwani s Clinic on the night intervening 28/29. 8. 2005 and in support of his submission, reliance is placed on Annexure- b. Learned APP for the State, on instructions from SI Anil Kumar, Submits that the certificate has been verified from the doctor and no such record is available with the doctor and opposes the prayer for bail. Petitioner has already joined investigations on number of dates. ( 3 ) IN the facts and circumstances of this case, application is allowed and petitioner is ordered to be released on bail on his furnishing personal bond in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the SHO/arresting Officer.
