( 1 ) NOTICE. ( 2 ) MR. Harish Gulati, Advocate, accepts notice of this bail application on behalf of the respondent. ( 3 ) THE petitioner seeks anticipatory bail in case registered against him under section 420/471/468, IPC vide FIR No. R. C. 11 (S)/05 with Police Station CBI scr-II, New Delh. ( 4 ) THIS FIR was registered against the petitioner on the directions of this Court in WP (Crl.) No. 5976/2006 as it was alleged that he had furnished a false certificate of his belonging to Kharia community though he belonged to Nonia community. The charge-sheet is stated to have already been filed. ( 5 ) LEARNED Counsel for the petitioner has contended that Kharia community and Nonia community are the same and they both belong to Scheduled Tribe/other backward Classes and the petitioner had no intention to take any unlawful advantage at the time of his appointment/promotion in the Department of Industry. ( 6 ) THE petitioner is a Government employee He is a first time offender. Furthermore, the petitioner is a permanent resident of Delhi and there is no apprehension of his absconding the trial. ( 7 ) IN view of the above and having regard to other facts and circumstances of the case, the petitioner is granted bail on his executing bail bonds in the sum of Rs. 25,000/- with one surety in the like amount to the satisfaction of the concerned Trial court. ( 8 ) COPY of this order be given Dasti to the parties. Ordered accordingly.
