JUDGMENT 1. - Heard learned Counsel for the parties. 2. This appeal is directed against the award of Motor Accident Claims Tribunal, Kotputli dated 25.11.1994 while deciding Claim Case No. 93 of 1992, Shailesh Kumar v. Balbir Singh and Ors. 3. In a road accident which took place on 5.4.1990, five persons Smt. Girni Bai, Mahendra Shah, Smt. Sunita Shah, Kumari Pooja and Umesh, servant of the fami ly who were going along with other family members in Matador No. D1D-5945 from Jaipur to Delhi and met with an accident with truck No. DIL-3417 which was being driven by driver Balbir Singh, non-applicant No. 1 and as a result of which, these five persons lost their lives and some were injured. 4. The learned Tribunal arrived at the finding that the said accident resulted on account of rash and negligent driving of truck No. DIL-3417 which hit the said Matador after going on wrong side of the road at about 3.00 a.m. in the night on Jaipur-Delhi Highway near Nawalpura Road. 5. While determining the compensation for the death of Smt. Sunita Shah wife of Mahendra Shah, aged 28 years, the Tribunal awarded the sum of Rs. 80,000 in favour of the claimants. The Tribunal has noticed that the said deceased Smt. Sunita was also having 25% share as partner in the business concerned M/s. Shailesh Synthetic along with her husband and her yearly income was Rs. 20,000 from the said business. 6. This Court is of the view that the award of lump sum amount to the tune of Rs. 80,000 for the death of Smt. Sunita is on lower side and, therefore, the case for enhancement of compensation awarded by Tribunal is made out. Even if the said lady is taken to be a non-active partner in the business concern, taking the net monthly income of Rs. 1,000 should make the ends of justice meet, therefore, the dependency benefit would work out to Rs. 1,12,000 (1000 x 12 x 16). This difference of enhancement of compensation would also be disbursed in favour of the two claimants i.e., Megha Shah and son Tarun Shah in equal proportions with 7.5% per annum interest by account payee cheques within a period of three months from today by the Insurance Company. 7. Consequently, this misc. appeal for enhancement of compensation is allowed.Appeal allowed. *******
