JUDGMENT 1. - Admittedly, the petitioner stood retired from service on reaching the age of superannuation w.e.f. 28.2.1989, whereas a charge-sheet under Rule 16 of the CCA Rules was issued to the petitioner vide memorandum dated 3.2.1990. No prior sanction or approval was sought to initiate departmental proceedings, as provided under Rule 170(B) of the Rajasthan Service Rules. In spite of objections been raised by the petitioner, the departmental inquiry was proceeded and concluded. However, the disciplinary authority while imposing a punishment on co-delinquent employee did not impose any punishment on the petitioner in view of his retirement. In the impugned order dated 7.10.1993 the petitioner was, however, held not entitled for remaining amount during the period of suspension except for the subsistence allowance already drawn by him. 2. After hearing counsel for the parties, I have carefully gone through the material on record. Since the departmental inquiry itself could not have been initiated without prior approval of the Governor, as provided under Rule 170(B), charge of negligence is wholly irrelevant so as to deny the petitioner the full salary for the period of suspension. Charge-sheet dated 3.2.1990 itself as also the impugned order dated 7.10.1983 cannot be sustained in the eyes of law. 3. Accordingly, the writ petition is allowed. The charge-sheet dated 3.2.1990 as also the order dated 7.10.1993 are quashed and set aside. Petitioner is held entitled for full salary during the period of suspension. Respondents are now directed to make the payment of arrears and other consequential retrial benefits to the petitioner within 60 days from the date of receipt of certified copy of this order. Revised PPO and GOP may also be issued accordingly within the aforesaid period. In view of total irregularity and illegality committed by he respondents in the present case, the petitioner is also held entitled for a cost of Rs. 10,000/-, which may be paid along with arrears as ordered above.
