Judgment Viney Mittal and j. JJ. 1. Written statement on behalf of respondent No.2 is taken on record. A copy thereof has been supplied to the learned counsel for the petitioners. 2. Shri A. P. S. Mann, learned counsel appearing for respondent no.2 informs the court that the site in question has since been sold through an open auction and the auction purchaser has even deposited 15% of the auction price. 3. Faced with the aforesaid difficulty, learned counsel appearing for the petitioner seeks to withdraw the present petition with a liberty to file a fresh petition on the same cause of action challenging the auction so conducted by respondent No.2. 4. The present petition is dismissed as withdrawn with a liberty as claimed by the petitioner. However, respondent No.2 is also directed to furnish details of the auction purchaser to the petitioner through a written communication within a period of two weeks from the day a certified copy of this order is received.
