Judgment Sunil Kumar Garg, President.—This appeal has been filed by the appellant complainant against the order dated 12.12.2002 passed by the D.F., Jaisalmer in complaint Case No. 140/2001, by which the complaint of the appellant was dismissed inter alia holding that the matter should be agitated before a Civil Court. 2. In our considered opinion, this finding is an erroneous one as the matter in dispute which pertains to when the transformer was burnt should have been decided by the D.F. itself. Both Counsel agree that the matter may be remanded back to the D.F. to decide the complaint afresh. 3. For reasons, appeal is allowed, impugned order dated 12.12.2002 is set aside and the matter is remanded back to the D.F., Jaisalmer to decide the complaint afresh on merits in accordance with law. Parties are directed to appear before the D.F., Jaisalmer on 24.05.2006.
