JUDGMENT 1. - The petitioner is Manager in a co-operative society called Gurguriya Gram Seva Sahakari Samiti, Tehsil Kama, district Bharatpur. He has approached this Court in effect and substance seeking direction to increase the age of retirement of the employees of the Co-operative Society to 60 years at par with the employees of the State Government. Rule 23 of the Rules framed by the Registrar lays down the age of retirement of employees of the Society as 58 years. The petitioner has, therefore, also challenged the validity of the said rule. 2. The basic question is whether the petitioner can claim the same retirement age as employees of the State Government. It is not in dispute that the employees of the co-operative society form a different class and therefore, the age of retirement applicable in the case of employees of the State Government by amendment in the Rajasthan Service Rules, i.e. 60 years cannot ipso facto be applied in respect of employees of Cooperative Societies. Fixing of retirement age is a policy matter and Courts cannot issue any direction in this regard. The petition is wholly misconceived and it is accordingly dismissed.Petition dismissed. *******
