REVA KHETRAPAL, J. ( 1 ) BY my separate Judgment announced today, Justice Jaspal Singh, Retired judge of this Court has been appointed as sole Arbitrator to adjudicate on the disputes and differences between the parties. ( 2 ) BY the present petition, the petitioner seeks interim relief as follows:"21. It is, therefore, prayed that the Respondent be directed to:-a ). comply with the terms and conditions of the Agreement dated 29th december, 2000 executed between the parties particularly Clause 2. 1 thereof and supply, provide and make available 125 M. T. Of FVW (+ 10%) on all working days to the Petitioner free of cost; b ). Not to send the waste generated in the Mandis of the Respondent to the land fill sites of MCD because that not only starves and deprives the Plant of the Petitioner from its essential raw material without which the Plant can't be run but also makes the Respondent incur huge losses in as much as the Respondent is dumping the waste in the land fills of the MCD while paying for the same a sum of Rs. 20,000 " 35,000 per day to MCD (the Respondent suffers loss on both counts this way in as much as the Plant set-up by the Petitioner can't be run at its full capacity and at the same time, the Respondent ends up paying MCD charges for dumping of the waste); c ). any other order or direction deemed fit in the facts and circumstances of the case may also be passed in favour of the Petitioner and against the respondent. " ( 3 ) THE above interim relief sought for by the petitioner is also referred to the sole arbitration of Justice Jaspal Singh, Retired Judge of this Court. The petition and IA No. 8915/2006 stand disposed of accordingly.
