S. P. MEHROTRA, J. ( 1 ) LIST has been revised. The Court has waited for sometime. However, the learned Counsel for the parties have not appeared. ( 2 ) THE case is listed today for consideration of Civil Misc. (Delay Condonation) Application no. 2007 of 2006 and Civil Misc. (Substitution) Application No. 2008 of 2006. ( 3 ) THE aforementioned Applications have been filed consequent to the death of Ram Bali Sahu (plaintiff-appellant ). ( 4 ) AS none is present for the applicants to press the aforementioned Applications, the Court has no option but to dismiss the aforementioned Applications for want of prosecution. ( 5 ) ACCORDINGLY, Civil Misc. (Delay Condonation) Application No. 2007 of 2006 and Civil Misc. (Substitution) Application No. 2008 of 2006 are dismissed for want of prosecution. ( 6 ) AS noted above, the aforementioned Applications have been filed consequent to the death of ram Bali Sahu (plaintiff-appellant ). ( 7 ) IN view of the dismissal of the aforementioned Applications for want of prosecution, the second Appeal, at the instance of the said Ram Bali Sahu (plaintiff-appellant), stands abated. ( 8 ) THE said Ram Bali Sahu was the sole plaintiff-appellant. Therefore, the Second Appeal stands dismissed as having abated. . .
